一、重點置於民事訴訟法之體系、重點、基本原理原則,以及解決問題之層次方法。重質不重量,期使同學於修完本課程後,在自行進修準備國家考試時,或實際運用時,能事半功倍。 二、第一次上課,煩請班代表成立LINE群組「113年學年度民事訴訟法」,以利聯繫。老師上課講義及資料,也會利用該群組補充,並煩請同學們以該群組上傳期末報告。 三、本課程原訂為週五晚間第11至12節課,所以,原本理論上,同學們每週五晚上時間均須空出,並前來上課,但為便利同學白天 行程,因此如同學們均無意見,則本課程調整為集中上課:113年9月27日、10月4日、10月18日、10月25日、11月8日、11月22日、12月6日、12月20日及114年1月3日共9次,每次18時20分至22時(以滿足34小時最低授課時數),如臨時需 調課(通常是調往其他週五),則另與同學協商或通知。 四、每次上課,煩請同學都要攜帶民事訴訟法、強制執行法、家事事件法及民法條文。
《 課程簡介 -- English 》
The Civil Procedure course is the law student’s fundamental introduction to the entire subject of legal procedure or process in all of its manifestations and contexts–civil, criminal, administrative, executive, and even legislative. While it may appear at first to be technical and formalistic, in fact procedure is the most profound of all legal subjects. Whereas the "substantive" law you have studied in other courses is concerned predominately with defining rules and principles of law for enabling or regulating the primary conduct of individuals or entities as among themselves, the concern of "procedure"--or, as it is sometimes called, "adjective" law--is to define how those substantive rules of law are established, applied, and enforced. Reading assignments are set forth in this syllabus. The class-by-class breakdowns represent approximations. During the semester, there will be alterations, deletions and additions. Any changes will be announced in class. Accordingly, the workload is substantial and the expectations for your level of effort and preparation are high.
Learning Objectives: The staple of legal education, particularly in the first year, is the appellate decision. In order to fully understand an appellate decision you must be able to think procedurally, to reconstruct the whole case from the beginning through the appellate decision. The objective of the course is to supply those thinking skills that are the foundation of legal education.
