本課程旨在培養學生運用法律邏輯進行法學研究、建構法律論證及撰寫學術論文之能力。課程以法學研究方法為基礎,結合法律解釋、法律論證、案例分析及比較法研究,引導學生建立嚴謹之法學思維,並提升研究設計與學術寫作品質。
課程內容涵蓋研究問題之形成、文獻回顧與評析、法釋義學研究、比較法研究、實證法學研究之基本方法,以及研究架構設計、論證策略、論文章節安排、引註規範、研究倫理與學術誠信等重要議題。另配合近年人工智慧(AI)技術發展,課程亦將探討AI工具於法學研究之應用、資料蒐集、文獻整理與研究輔助功能,以及其於學術倫理、著作權與研究誠信所衍生之法律問題,使學生能正確且負責任地運用新興科技從事法學研究。
課程將選讀國內外重要法學期刊論文及司法實務案例,分析不同研究方法與論證模式,並透過研究計畫撰寫、論文評論、口頭發表及論文草稿研討,引導學生逐步完成具學術水準之研究成果。特別鼓勵學生結合自身司法、行政、企業或法律實務經驗,發展兼具理論深度與制度改革意涵之研究議題,強化法學研究對實務發展之貢獻。
修習本課程後,學生應具備獨立發掘法律問題、規劃研究設計、整合法律文獻、建構法律論證及完成碩士論文之能力,並能以嚴謹之法學研究方法分析新興法律議題,提升學術研究與專業實務之整合能力。

This course serves as a core research methodology course for the in-service Master of Laws (LL.M.) program. It is designed to cultivate students' competence in legal reasoning, legal research methodology, and academic legal writing, enabling them to produce high-quality scholarly research grounded in both legal theory and professional practice.
The course introduces the fundamental methodologies of legal research, including doctrinal legal research, comparative legal studies, and empirical legal research. Students will develop the ability to formulate research questions, conduct critical literature reviews, design coherent research frameworks, construct persuasive legal arguments, and prepare academic manuscripts in accordance with recognized legal citation and academic writing standards. The course also addresses academic integrity, research ethics, and responsible citation practices essential to legal scholarship.
Recognizing the growing impact of artificial intelligence (AI) on legal research, the course further explores the appropriate use of AI-assisted research tools for legal information retrieval, literature analysis, and academic writing support. Ethical and legal issues concerning AI-generated content, copyright, transparency, and academic integrity will also be critically examined.
Through the study of leading legal journals, judicial decisions, research proposals, peer reviews, seminar presentations, and thesis workshops, students will strengthen their ability to integrate professional experience with academic inquiry. The course encourages participants to transform practical legal issues encountered in judicial, governmental, corporate, or legal practice into rigorous scholarly research with theoretical significance and policy implications.
Upon successful completion of the course, students will be capable of independently identifying legal research topics, designing research methodologies, constructing persuasive legal arguments, and producing master's-level legal theses that meet the standards of advanced legal scholarship.
