隱私權的保護在近來逐漸受到重視,尤其在資料經濟快速發展的數位時代,資料的取用已成為所有創新服務的基礎,無論係網路上的各項服務,如社群媒體、電子商務、金融科技等,都無可避免必須面對個人資料的運用。而資料運用的合法規制與保護,是所有企業無可避免面對的重要課題,也是企業內部法遵、法律實務工作所必須深入研析,以提供客戶或委託業者具體有效建議之必備法律專業職能。 個人資料保護法(個資法)於101年正式實施,國內無論是公務機關、非公務機關甚至是個人,只要有蒐集、處理、利用個人資料行為,皆有可能受到規範,影響層面廣泛。倘若有違法行為產生,將可能面臨民事、刑事、及行政責任的處罰,最高可能將被求償二億元的損害賠償金額。如何在保障資料當事人資料安全性的同時,又能有助於資料交換運用的經濟價值,協助各產業的商品或服務開發應用,進而提高產值,將是本課程的授課重點。 本課程將解析國內機關在蒐集、處理、利用個人資料時,必須要遵守的義務、符合的要件規定、資料類別的區分對於資料利用的影響、以及哪些違法行為將面臨什麼樣的處罰等規定。此外,課程中將藉由案例說明實務運作建議,協助學生提升法遵意識,增進交易信賴,並促進國內產業發展。

The protection of privacy has received increasing attention in recent years. In today's digital era, where the data economy is rapidly expanding, access to data has become the foundation of virtually all innovative services. Whether in online services such as social media, e-commerce, or financial technology (FinTech), the collection and use of personal data are inevitable. Accordingly, the lawful regulation and protection of personal data have become critical issues that all businesses must address. They are also essential areas of expertise for corporate compliance professionals and legal practitioners, who are expected to conduct in-depth analyses and provide practical and effective legal advice to clients and entrusted organizations. Taiwan's Personal Data Protection Act (PDPA) officially came into force in 2012. Since then, government agencies, private organizations, and even individuals who collect, process, or use personal data may all be subject to its provisions. The Act has a broad scope of application and far-reaching implications. Violations may result in civil, criminal, and administrative liabilities, with damages in civil litigation reaching as high as NT$200 million. This course focuses on how to safeguard the rights and security of data subjects while facilitating the economic value of data sharing and utilization, thereby supporting the development and application of products and services across various industries and enhancing industrial competitiveness. This course will examine the legal obligations that organizations in Taiwan must fulfill when collecting, processing, and using personal data. It will cover the statutory requirements for lawful data handling, the classification of different categories of personal data and their implications for data use, as well as the legal consequences and penalties associated with violations. In addition, the course will incorporate practical case studies to illustrate real-world applications and best practices. Through these examples, students will strengthen their compliance awareness, enhance trust in commercial transactions, and contribute to the sustainable development of domestic industries.
