營建法規:
本課程旨在使同學瞭解營建法規體系的基本知識，並概略具備尋找解決營建工程可能遭遇之法令問題的能力。
營建作為國家建設的一個部門，關係國人生活、生產及生存環境的品質及安全，故需要一套管理法令予以規範。營建管理係指營建工程有關國土規劃設計、開發建設、建築設計、工程營造及相關營建產業管理。就法令體系而言，營建法規包括：區域及都市計畫法、非都市土地使用管制規則、新市鎮開發條例及都市更新條例、國民住宅條例、共同管溝法及建築法等作用法，以及建築師法、技師法及技術顧問公司管理條例、營造業法、建築開發業管理條例等產業管理法規。廣義的營建法規尚可包括：環境影響評估法、山坡地保育利用條例、水土保持法、水利法、發展觀光條例、離島建設條例、大眾捷運法、鐵路法、公路法、土地徵收條例、民間參與公共建設及政府採購法等公共工程相關法規。
法令規章係政策執行的依據，隨著社會、經濟發展及環境問題的產生、科技的日新月異，及適應未來發展的需要而迭有增補、修正與刪減。法令規章之引用必須掌握法令規章之精神，才能因事、因時、因地制宜，而不致斷章取義或因循苟且，甚至因私枉法。本基礎課程旨在透過營建法規的基本知識之介紹，包括營建法令體系及各主要營建法規的立法架構、立法的時空背景、社會經濟發展的政策變遷，並進一步探討當前營建法令規章之不足及改進建議，使同學瞭解營建法規與營建工程之關係。至於詳細的建築設計、結構設計及消防等有關建築技術規則、工程施工規範及營建管理實務等將留待另一個課程。

Construction and Planning Law:
The aim of this course is to understand the fundamentals of Construction and Planning Law and offer students the ability to solve the problems in their future career.
As an important department of the government, construction works improves the quality and safety of people’s life, productivity, and environment; therefore, there needs to have a legal framework to administer it. Construction management refers to national land plan, land design, land development, architectural design, engineering, and industrial management relative to construction. A narrow sense of construction laws and regulations includes Regional Planning Act, Urban Planning Act, Non-urban Use Control Regulation, New Town Development Act, Urban Renewal Act, Public Housing Act, Common Duct Act, Building Act, Architects Act, Professional Engineers Act, Act of Governing the Administration of Professional Engineering Consulting Firm, Construction Industry Act, and Act of Governing the Building Development. A broad sense of construction laws also includes Environmental Impact Assessment Act, Utilization and Transfer of Reserved Mountainous Land, Soil and Water Conservation Act, Water Act, Statute for the Development of Tourism, Isolated Islands Construction Act, Mass Rapid Transit Law, Railway Act, Highway Law, Land Expropriation Statute, Act for Promotion of Private Participation in Infrastructure Projects, Government Procurement Act and so on.
Laws and regulations are the basis of policy implementation. They need to be added, amended, and repealed according to the development of society and economy, environmental problems, technology development, and future trends. Citing the laws and regulations must follow its spirit to avoid quoting out of context. The aim of this course offers students to understand the relationship between Construction Law and construction engineering through introducing the fundamentals of Construction Law including construction law systems and legislative framework of main construction laws, background of the times, change of society and economy development; furthermore, to explore and discuss the inadequacy and improvement of construction laws. As for technical rules including architectural design, structural design, fire service and other relative rules of construction technology and construction standards will be discussed in another course.
